Employee Free Choice Act ("Card Check" Legislation)

Goal: DEFEAT EMPLOYEE FREE CHOICE ACT
Background

The Employee Free Choice Act (HR100/S1041) would revoke an employee's right to secret ballot in regards to a decision to unionize private businesses. Also under this legislation, if an employer and the union cannot settle on a contract within 120 days, the dispute goes to an arbitration panel, which can impose a contract.

Recent Action The Partnership has signed on to a coalition headed by the Manufacturers Alliance of Central New York in opposition to Card Check. On April 14, the Partnership urged its members to contact the WNY Congressional delegation with their company's opposition to EFCA.
Recent Progress

On July 17, the New York Times reported that EFCA as we know it is essentially dead, however compromises continue to surface that present each of the bill's three job-killing components in a variety of forms.

Next Steps

Given the new labor tactics on EFCA, the Partnership will continue to work with the U.S. Chamber and Business Council of NYS to keep the pressure on Congress in opposition to this bill in all forms.
